Breath Tests aren't Infallible - Questioning Blood Alcohol Content (BAC)

Breath tests measure the amount of alcohol in the body's blood by analyzing air from the lungs air sacs. Air taken from deep within the lungs will typically be higher in blood alcohol concentration than air taken from higher in the diaphragm. When an officer tells you to, "take a deep breath and blow as hard as you can," he or she may be artificially inflating the breathalyzer BAC reading.

Additionally, if a breathalyzer isn't maintained regularly, its calibration could shift, making its results inaccurate.
